TEFL TEACHER WARNING - AVOID Apart from the legal irregularities that occur here, the general day to day operation is run on intimidation and fear. 99% of the new hires here are NQTs (newly qualified) and oblivious to Spanish labour laws, and this is for a reason, NQTs are generally eager to please and are susceptible to being taken advantage of, in more ways than one. Management are unsympathetic to teachers personal lives, mental health and general well being, and expect utmost dedication and sacrifice, 24/7 at the drop of a hat. Teachers are entirely expendable and certainly never appreciated. Communication within the business is a total shambles and incredibly aggressive. Zero culpability within management where each blames the other for things that go wrong and statements like “you must”, “you are expected to”, “subject to unpaid leave if you don’t” are common. Environment of fear actively enforced. To protect yourself I strongly recommend you familiarise yourself with the legal framework that governs employment conditions when working as an English teacher here. In Spain there are two layers of employment law: the top layer is the Workers Statute and this covers general labour law, BOE number: BOE-A-2015-11430. The second layer is more specific to the specific sectors within Spain and these are known as “convenio colectivos”. The convenio colectivo you need to read and understand, which is the one you will be contracted under, is called “enseñanza no reglada” (unregulated education), BOE number: BOE-A-2021-17560 (if you google the BOE numbers you will find them, and you can use the translate function if you need to). My first piece of advice: do not let them pressure you into signing your contract (or any other paperwork you do not understand), this is a standard tactic here. You have every right to take it home and check it, and believe me you need to do exactly that. Understand that the convenio protects employees from firing and has a clear disciplinary procedure, both ways, do not be intimidated into signing. They cannot penalise or sack you. First thing to check, are you contracted as “Profesor” or “Profesor Auxiliar”? Did you know the latter earns 2000€ per year less than the former? I can tell you you will be carrying out the duties of a teacher, planning lessons, responsible for your own classes/students, marking homework, marking exams, writing reports, this is “Profesor”. What group are you in, GRUPO I or GRUPO II? You must be in GRUPO I. These are just the starters but the character limit prevents me from going on. There are people who can help, protect yourself, speak to your fellow teachers, work together, research the convenio, know what your contract says, demand your nómina, understand it and ask questions. Do not let them intimidate you.
